I would vote for the FBI to determine if cases are handled by civilian courts or the military and in borderline cases, citizenship should be the deciding factor in the determination.

For terrorists engaging in a terrorist act in the US. For those outside the country, it's another matter.

It seems to me that there should be clear lines of demarcation on things like this, a neat matrix would be nice, published policy and procedures, coordination protocols, and staffs set up to handle just this sort of thing.

But I'll bet they're reinventing the wheel right now in Georgia.
