Lincoln didn't need to declare war, and neither would any President. The Insurrection Act was in place in 1807 too. Any act under the Insurrection Act is excepted from Posse Comitatus because it is expressly authorized by the Constitution and Congress.

The Insurrection Act expressly allows the President to deploy federal troops "to suppress, in any State, any insurrection, domestic violence, unlawful combination, or conspiracy" if such results in a condition that "opposes or obstructs the execution of the laws of the United States".

In other words, get ready for the smackdown, the Marines are comin to town.
