It looks to me like AMD's real cost to produce product will be compared to Intel's costs through subpoena. That will answer a lot of why AMD is not able to compete. It's not like the known process of finding and producing oil...

It looks to me like you don't understand how a tailored rebate schedule can be exclusionary to even an equally efficient competitor.

All AMD has to show is that the units Intel sold over the customized trigger point were free or nearly so, and it won't matter if it costs AMD a little more to produce a produce a processor (an assertion I also doubt is true.)
