The amended IEEE, WiMAX Forum, 3GPP-ETSI FRAND policy agreements include both essential technology to core and optional use of technology (non-essential technology). How broadly that net can be cast is a matter for debate and probably tests by the courts but it is intentionally aimed at incorporating all technology used in present and evolved wireless and other systems governed by the various standards.

That sounds like a good idea going forward, but if they attempt to impose that retroactively, I would imagine a huge number of suits.

Ultimately though, I think that IP peace depends on transparency. Prior to the adoption of the standard, all of the parties need to declare all essential and non-essential IP and the rate they plan on attempting to charge non-IP holders. It is hard to charge that companies arent being FRAND'ly if you know the terms before the standard is adopted.

Sounds to me that the only ones with valuable IPR remaining are nonparticipants with non-essential IPR.
