Thinking about that restaurant ban, the truly obese are often legally classified as disabled- the disabled are a protected class. The simply obese, but not disabled, would not be. That weird Miss law could (potentially) create two tiers of treatment for obese people- with strict scrutiny applying to the treatment of the disabled obese, and regular scrutiny for the merely obese but not disabled. Or that's what flashed across my mind a minute ago. Maybe I'm wrong- it's been ages and ages since I took con law.

While I understand the frustration people have with the burgeoning girths of US citizens, I look at the students in my classes and despair occasionally, I do not think we can solve this with legislation of this type. Firstly, it's a legal minefield. Secondly, it's cruel. Thirdly, there are better ways to approach the problem (as Neolib and you already discussed).
