Extremely unlikely. In fact there was excellent precedent to indicate they were not. The fact that no one had beaten Altria in the first 200 lawsuits didn't stop lawyers from continuing to try, and to run up both sides' legal bills.

Your Judicial Review comment is typical of your red herring comment history. It slows down surveillance by a week and a half. Often there is only one chance to intercept communications. I don't think many terrorists hold teleconferences quite that long.
