I expect that they thought it through with the same care and attention that the banks who created the sub-prime mortgages, and the CDS, and all the other alphabet soup financial concoctions that are blowing up all around us did! It isn't a specific problem with GLD but GLD would be very badly affected as there is no way to cause a short squeeze in GLD with unlimited share issues. This limits the risk for the shorts. It's a problem caused by unlimited and unregulated short selling which has been allowed to proliferate in an unrestricted manner without any need for shorts to cover or deliver.
