In reading Qualcomm's pleading in the Broadcom case, I think it would be fair to say that Qualcomm offered Broadcom a few negotiating positions, some of which can not judiciously be characterized as FRAND with respect to Qualcomm and Broadcom

I don't agree one tiny bit. It all seems absolutely fair and reasonable to me in the context of negotiating and, as you put it, "with respect to the parties at the table" (QCOM's semantical arguments in brief not-withstanding) from the QCOM position.
BRCM's position to me seems less FRAND, but reasonable in the context of horse-trading.
