Waterboarding only worked because it scared people to think that someone really would drown them. Now that everybody knows it doesn't work, it doesn't even hurt much. It's not nor ever was torture. Whoever let the cat out of the bag, they should be tortured, or maybe just shot.

Bush doesn't get to decide what is torture and what isn't torture but he is welcome interpret the torture statutes as long as he can reasonably support his interpretations and consequent actions. He can also be over ruled by our checks and balances system if his rationale is not strong enough.

There are opinions on both sides. However, opinions expressed by people who have little or no information on the statutes, and/or who express 99.9% of their opinions to promote partisan political interests, render their opinions meaningless outside of simply declaring their party loyalties.

"Most rational people do."

The issue can be resolved rationally by the justice department. Those are the rational people we have employed for this task.
