Qualcomm has discharged its FRAND obligation by offering fair and reasonable terms to Nokia for licensing. Now that Nokia has refused these terms, Qualcomm can return to the fundamental right granted by patent or any other property right, the right of non-use. That is the risk to Nokia.

Or that is the scenario presented. But court documents are always biased/adversarial.
