I think it's all about money.

Police get a lot of money now from the drug "wars". All the property they get to seize- that's big bucks for shiny new toys.

And the prison system- big money and big lobbyists. What would happen to those for profit prisons if the system stopped growing? What you subsidize you get more of- and we're pretty much subsidizing the warehousing of criminals- is it a big surprise we get more of that?
