This is called "Judicial Activism".

Bush v Gore was "Judicial Activism", thus no precedent. Scalia is the most activist (political) judge you can imagine.

I agree with Obama but i am a strict constructionist in the sense that judges with conservative temprement should be the ones to tinker so they dont get too far from original intent. Original intent is very important but not the sole criteria. So i didnt have problems with alito or roberts but i did with bork and i am sure with some others on the right.
