OK, if the main point is whether it is a novel concept or not, then no, it is not a novel concept. You are correct to point out it is a familiar concept.

Familiar, but with no claim of viability in the jurisdiction. The novelty in AMD's assertion is the pretension that it is an accepted concept in the context of their suit.
