You're right. There's no guarantee McCain wouldn't select the same judges Obama will. I guess we'll know a little more about how he thinks after he selects his VP.

McCain is on record as wanting to nominate justices in the mold of Roberts, and Scalia. He's certainly not likely to nominate someone like Ruth Bader Ginsburg.

Re: McCain Feingold. I know George Will is not exactly a constitutional scholar, but when that legislation passed, he wrote a column detailing why it was unconstitutional.

I couldn't believe it when it was upheld. In my judgement one of the worst pieces of legislation in many years. And of course it's primary intent has never been achieved. Worsened, if anything.
