One of the things cases like these do, I'm convinced, is undermine the Roberts' image as a center right judge, a pragmatist more interested in process than substance. He's far more a Scalia type than a Kennedy type. The court clearly has four hard core right jurists; the remaining five are as unpredictable as jurists should be.

Same here on Roberts. For some reason I thought he might be something of a moderate, but I'm not only disenchanted with him but exceedingly wary.

Considering his age, I fear he'll disappoint me for the rest of my natural life.

Remember when he was first appointed Chief and publicly stated his goal was to 'lead' the Court to more unanimous or close to unanimous decisions? I don't recall his giving any explanation for it and at the time I was left feeling uneasy by the possible ramifications of what could be behind this in terms of his mindset.
