I had the same reaction to that "clogging the courts" phrase. Some of the articles on RW threads had logic to their objections and I could understand. But that was NOT one of them. I've wound up realizing that I know way too little law, and that even if I knew it, this issue, as is true for so many con law questions, is not that simple. I did think Scalia's comments about making things harder, more Americans dying, etc were irrelevant and way too emotional.
