No, they're not morons. They're just exercising the power of the Court to interpret the Constitution in whatever way they feel like.

Funny, listening to Rush yesterday on the "no death penalty for raping a child" and he was going off on the supremes and saying they might as well do away with lawmakers because the supremes won't let them make law. Now today he is applauding the supremes for defending the constitution against the lawmakers in DC.

I guess the 'activist court' thing depends on the issue at hand.
