No, as I understand it, actually the paper assumes the 2nd Law of Thermodynamics is working normally. As much conduction and convection can go into the atmosphere as happens in real atmospheres.

4. The only way the fourth power of the surface temperature can exceed this limit is to be covered by an atmosphere that is at least partially opaque to infrared radiation. This is the atmospheric greenhouse effect.

That is how I see it. Maybe you could enlighten us further??
