I think he would try to do it by Executive Order since it's one of many, many things he could not get through Congress as President. Then it would bounce back to the courts, which McCain hopes to keep tilting in his favor but again, he will run into Congress. Pretty much everything McCain tries to do will be a head-on collision and a messy back and forth with an enlarged and entrenched Democratic majority. Which means politics inside the Beltway will be EXACTLY the same as the last eight years or more.
