Anyone still shorting should really consider how much of this story is a matter of personalities between Costello and Hsu. Remember Hsu left Cadence when Costello went against him on an internal matter. Once done, they both took it as an personal task to eliminate the other. If Costello feels so strongly about theft, what's he doing working for a convicted felon like Milken?

The civil case will get less and less visibility at Cadence until it settles for some measly amount just so both companies can get on with business. Costello's legal assaults have been able to slow Avant growth, but that tactic will only work for so long. A CEO like Costello forces his personality on a company, now that he is gone, who is going to drive this case?

The criminal case will probably disappear also. From what I know, the DA's evidence isn't as strong as they let on. There certainly was no slush fund. And the indicted principles I've spoken with are quite admament about their inocence. Finally, there are sympathies in the valley that it would be better for this case to be quietly settled so that the growth and startup atmosphere can continue.
