If you are saying the law is what the 5 of the 9 US Supreme Court justices say it is you're right But they are at least to supposed to follow precedent (or explain why in the particular case before them the precedent doesn't apply)

(As I pointed out in my other answer marriage is not under their jurisdiction--yet)

We find this way of doing things preferable to fighting another civil war.
