Malpractice? Do they even have a German word for that?<G>

Seriously, tort reform would have to be a big part of the fix. And not some minor cosmetic reduction in damage awards either....more like elimination of jury trials in malpractice cases.

The primary difference in medical malpractice suits between Germany and the U.S. are that the Judge may appoint his own medical experts for a less biased view, in addition to those presented by the litigants. Plus there is are no jury decisions.

In the U.S. a large portion of each claim is for future medical care. In Germany the state, being the medical payor, is already liable for this future care, so the total pay-outs appear to be smaller than they actually are.
