What is vague about the term civil rights and equal protection under the law?

Under what circumstances are they a gray area to you?

"The constitution doesn't define marriage, or otherwise insist that government's recognize any particular thing as a marriage."

I don't care if the government recognizes marriage and, in fact, I believe it SHOULD NOT. I believe government should recognize contracts including one called civil union. People make prenups all the time...so what?

Churches or other organizations can then recognize 'marriage' as they please. The underlying structure would be a contractual obligation and benefits arising from the civil union.

If you can't sign a legal contract, you can't get married which means children can't get married. If you want to 'defend' marriage then try and outlaw divorce.

I haven't seen a right wing group go after divorce....why is that?
