I might go with the former over the latter.

But it doesn't change the excuses he gave for not talking to the press ('death threats' and 'I get to be a dad').

That kind of behavior looks guilty, amateurish, and suspicious

Three things are going on here:

First, the legal scandal, which Emanuel is involved with, but not accused in, as we now know from today's leak. "He is not a target of the investigation." Just because he is not charged does not mean he didn't do something he shouldn't.

But second, he is at the cusp of the political scandal, which involves, "how much of a bribe attempt was made on him by Blago?" We know that he and Blago are both a couple of foul-mouthed Chicago Pols and what Fitz has on tape could sound devastating politically. The Grand Jury involved could well call him. If they do, just that fact alone explodes this politically.

Third, Emanuel is right next to Obama. As his Chief of Staff, nobody is closer. He was involved in a couple of hours of conversation with Blago about the Senate seat that Fitz has on tape. If it sounds as bad as it probably does, how much of it was Obama aware of? This goes right to the top.
