I think you should have a different result where the vehicle through which you invested is a partnership or LLC, as opposed to a brokerage or or mutual fund account.

When you invest in a partnership or LLC you are throwing your lot in with your fellow investors ... that's not the case where you send a guy $1,000,000 to manage for you.

I think the people who invested directly with Madoff may be in a much better position than those who invested indirectly through a hedge fund.

Madoff "Investors" May Have to Pay Back 6 Years of Withdrawals

By now the multi-billion dollar Bernie Madoff Ponzi scheme fraud is old news but the potential damage to the victims of the scam is just starting to come to light. It seems that an obscure New York State Law could see some Madoff investors having to return all monies withdrawn from the fund during the past 6 years, including any withdrawal of their initial investment principle.


I've heard this before. I don't get how that's fair.
