I think we agree on one thing here. When its clear you must act. If its not clear, you have to do what you consider the right thing and thats a balance of values and consequence of not acting. But, you need to also accept that bush/cheney poisoned the well with their cavalier attitude with this subject. For cheney it almost seemed to border on the sadistic and that attitude filtered down to the troops (some military and some CIA). So lets place blame everywhere it belongs and not only on lefty goody two shoes types like Teddy.
