How do you deal with the extreme situation i started this debate with. School will be blown up unless you get info from captured leader. Nuke will go off in NY unless.....same scenario. That to me is battlefield conditions--would you allow the kids to die or 2mm in NYC to be vaporized if you personally could stop it or some agent of the govt. I think this type of thing is materially different from the mass murders you list as well as Abu Graib disgrace. Thoughts??
I accept you are on the high road and clearly INODE is a snake but there are times we might have to act like a snake to save millions. I suggest we codify the situations that meet this condition. Parsons says no--against the law all the time but do it anyway in critical situation and you will likely get off thru jury nullification if charged.

Abu Ghraib was important only in the context of what it meant to the American military and the war effort. In the overall scheme of things, Abu Ghraib as an example of "torture" or even "prisoner abuse" is absolutely trivial.

Your own post shows this -- there are literally thousands of known incidents throughout history that were far more egregious than what occurred at Abu Ghraib. Our dead soldiers being mutilated, as one example.

Abu Ghraib was a media event. Not an incident involving "torture" as the term has historically been used.
