I see no constitutional problems that would be more than moderately likely to hold up in court as the courts would likely ignore the borderline bill of attainder issue, and the courts have already allowed retroactive taxes, so they seem to ignore the ex-post facto principle on such taxes.

But the later is really clear cut and obvious. The courts are falling down on their duty when they allow such ex post facto taxes.
