You are quoting from the original Complaint that AMD filed in 2005. Those are mere allegations that later had to yield to actual facts as the case developed.

McGee's quotation comes from a recently filed document -- the plaintiff’s joint preliminary case -- that states the facts that AMD now asserts are true.

What you have done is shown how AMD's allegations are false and later be corrected by AMD itself when confronted with documents and testimony under oath -- also known as evidence.

For CJ the mind reader: were AMD's false allegation the result of sloppy workmanship or willful misrepresentation?
