It seems a weak spot in our democracy is the ability of the congress to act in a timely manner.

As a country we could not wait to end segregation, so the courts were "used".

I know that is a difficult concept for some and a fine distinction, but we need to face reality to survive.

And that is the effeacacy of the reality of the government we humans have tried to construct to protect us from ourselfs and regulate our society.

We neeed to rely on the courts a lot when the congress gets stuck or too far behind the times, like segregation.

One way or the other one branch of government had to end it!

We liberals get it. the right wing does not get it.

Although the right wing sure as hell used the judicial branch of government to call the 2,000 election!!

but it requires a legislative act to make it happen.

If it required a legislative act it wouldn't be an action of the court.


Much legislation in this country does start at the judicial level but before it can become law it must be legislated. At times that legislation is forced by a court ruling.
