Ann, Here is my spin. Sotomeyor was merely following established precedent in the 2nd circuit when she was part of the per curiam decision which was concurred in by 3 other judges. She is a judge who follows established precedent. She is not an activist judge. In this case, the activist judges were the Supreme Court majority who over ruled established precedent.
