A few years ago I was trapped in a loss in a stock that was being shorted without mercy. Some brokers with large holdings finally got the SEC to investigate what we thought was "abuse of the naked shorting privilege". Turned out there was a large hedge fund loaning its shares that had been acquired in a private placement. SEC decided it was all legal. There are lots of way to skin a cat. But my experience with short sellers is that its usually just a matter of math. A complex capitalization that is in the process of unwinding is a magnet. As the capitalization simplifies and the earnings story emerges, TPRO will be far less attractive to hedgers.
