It wasn't a "power" given to the government but a "right" conveyed to its citizens. the fact that you don't understand that the US Constitution doesn't convey rights to the citizens, makes this conversation futile and pointless.

I seem to remember something about the right to life, liberty and the pursuit of happiness. It wasn't a "power" given to the government but a "right" conveyed to its citizens. From the Declaration of Independence We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. The 9th and 10th amendments in the Bill of Rights (note "protection" and "enumeration", not conveyence of rights) Ninth Amendment – Protection of rights not specifically enumerated in the Bill of Rights. The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. Tenth Amendment – Powers of States and people. The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
