i think there is a potential lawsuit (most especially for my son who was nothing but an innocent victim, ie....passenger in the car)

proving damages would be hard....after all he *eventually* found his way after hours walking on foot in a strange city to the house....and thankfully he wasn't harmed physically in the process...

but what i and my daughter, and my son and my BF went through was hellacious, and it cost thousands of dollars to engage a lawyer to defend himself only to find out after months of bureaucratic incompetence (they couldn't find his blood test results.... yeah, right....) that proved conclusively that there was no alcohol in his blood

but the odds are totally stacked against the victim of this type of police abuse...they only need to suggest that there was 'reasonable cause' (detected the scent of alcohol) to arrest the driver, despite the fact that he passed the breathalyzer...ultimately they were convinced that there *might* be some type of drug usage...(his blood test was for all types of drugs imaginable, not just alcohol, to which the results were ZERO on all counts)

the basic response of the cops is 'oops, sorry, never mind, my bad' and the onus is on the victim of this abuse to prove damages at much expense to themselves...

and yes it was an expensive sports car, and yes he happens to be a 'minority' so you can figure out what the white cop might have been thinking
