When fraud is suspected, there is normally a temporary halt by the SEC for investigation, per IDID, SEXI, NVID etc etc. When trading resumes, the stock is usually worthless. If the investigations shows there is fraud, the guilty parties are charged.....the shareholders are left holding the bag. They may or may not collect a few pennies on the dollar after a few years, if there is anything left from the proceeds after fines,penalties, and costs of litigation are paid.

If you are a market maker and show adequate risk in a security, you absolutely can be short a stock in an inventory account. Otherwise there would be no such thing as "principle" business.
