The constitution doesn't require trying those we are at war with. It might be read as requiring trials for them if we are to charge them with war crimes or ordinary crimes, but not to hold combatants we captured while fighting a war against a foreign power. If they where Americans and the detaining of them was in response to an insurrection, or an invasion they supported, then it would require a trial of them, if congress didn't suspend habeus corpus.
