The permit requirement was curtailing the student's right to freedom of expression. The student was expressing himself in a manner that was not in any way a safety risk, indecent, disorderly, or disruptive to the educational mission of the institution. Do you think such requirements are just and in the spirit of our fundamental rights?

How do you feel about indecent material displayed in public, like porno material on the news stand, the internet, public libraries?

How do you feel about the distribution of bomb making materials?

What about cyber stalking and harassment?

Is it a state college?

If so than it is government infringing on free speech. Yes the 1st amendment says "Congress shall make no law", but

1 - Something can be a violation of free speech without violating first amendment rights.

2 - If it was a federal government university (which almost certainly it isn't) it would still effectively be congress making the law, its power and funding derive from congress. Just as the EPA couldn't pass some reg that said political speech was an environmental hazard and thus shut it down, other federal organizations couldn't as well.

3 - As for state bodies - The 14th amendment and incorporation is considered to extend the rights to be effective against state governments.

Now if its a purely private body, ok than you have a point.
