John, if you recall our previous discussion regarding Kagan you'll remember that I had reservations about how lively her mind was and whether she had the kind of grasp that could create long reaching wisdoms. After watching portions of the confirmation hearings I'm much more optimistic. I think that the way she handled the questions showed that she's a very good thinker with a logical and practical mind and she may be a jurist who leaves a trail of wisdoms. In addition, her "kill you with kindness" approach may be effective in creating a bond between her and the swing judges. I now see this the way you did when we had those exchanges. Ed
