INTERESTING CASE you link to - a class action COMPLAINT where the DEFENDANT, GENWORTH, failed to follow Brinker's recommended allocations more that 50% of the time.

WHERE's THE COURT's JUDGEMENT on this gem ????

The COMPLAINT states Brinker's relationship to GENWORTH is that of contractual consulting and recommending asset allocations based upon his timing model. I see no indication of a conflict of interest on Brinker's part - I did not see that Brinker held any ownership interest in GENWORTH (formerly BJ Group owned by brinker but sold to GENWORTH).

Instead, from the COMPLAINT it appears that GENWORTH MANAGEMENT failed to EXCLUSIVELY FOLLOW Brinker's recommended asset allocation. From my viewpoint, the plaintifs contracted to buy Brinker's asset allocation exclusively, and, GENWORTH failed to provide such asset allocation for a material portion of invested funds. In my opinion, GENWORTH WILL LOSE THIS CASE.

From all of this, you would have us believe that the evil BERNIE MADOFF has a moral equivalence to Bob Brinker.

ABSOLUTELY ABSURD in my opinion! This is an example of how distorted one's reasoning gets from holding onto anger to 10+ years over Brinker's missed market calls. BOY, DO YOU NEED HELP!

Interesting. So the firm is essentially getting sued because they didn't follow Bob's recommendations closely enough. Hmmm.
