Putting people who engage in fraud out of business is a very different activity than putting in place an overall limit on the number of people who can conduct the business. The former (if done right) is in the consumer's interest, and doesn't abuse anyone's legitimate freedom. The later hurts consumers, makes the industry less efficient, and limits freedom.
