It is absolutely true in California. You could choose a minister, rabbi or a clown- and then take that agreement to your court appointed mediator. If both parties wish to abide by the minster, rabbi, clown's decisions in the matter- then the mediator probably won't interfere unless it's so odd it violates public policy. The courts LIKE people to work things out in advance- even if it's with the help of a clown. This is true in California- I have no idea what other states do. Family law varies from state to state- but I feel sure that what Cogito says is not patently false in most places.
