Unfortunately, Prop 23 is trailing in the polls -

From a report of the Field Poll in California -

San Francisco (Platts)--31Oct2010/953 pm EDT/153 GMT

Proposition 23, a California ballot initiative that would suspend
implementation of a state law requiring reductions in greenhouse gas
emissions, is supported by only 33% of likely voters, according to a
non-partisan Field Poll released Sunday.
According to the poll results, 48% of likely voters oppose the
referendum, while 19% are still undecided. California voters go to the polls
on Tuesday.
Proposition 23 would suspend the state's climate law (A.B. 32) until
California's unemployment rate, currently more than 12%, falls below 5% for
four straight quarters.
A Field Poll in late September found that 45% of likely voters oppose the
referendum, and 34% favored it.
The state's climate law, which requires that GHG emissions be reduced to
1990 levels by 2020, has been attacked by supporters of the initiative,
including refiners Valero and Tessoro, as a jobs-killing measure. Opponents of
proposition, who have outspent opponents, argue that the law will increase
investment in green energy technologies and create jobs.

This proposition had relatively little to no advertising support, they did not utilize talk radio to get to the conservatives and drivers who don't want to be stuck in tiny cars.

This prop was mostly sponsored by out of state interests who did not put enough serious thought into how to campaign.

The sponsors also should have run this on the Primary Elections in the Spring, where the Republican turn out was higher because the Reps had two seriously contested primaries, and the Democrats did not have anything interesting to draw in their voters.

Also the oil companies were out spent by a bunch of hippie enviros...
