I saw a female rep. of the AZ Tea Party on FOX....part of a panel discussion. I was doing other things while listening, but I think she basically said that if he had been formally arrested and the police had formally requested the shooter receive a mental evaluation, that paper trail would have turned up on a background check and blocked his purchasing of a weapon. That was AZ law I think she said. As for identifying the mentally ill, it's common for such a person to try to deal with their condition by self-medicating....alcohol and drugs. Then you have a situation where bystanders don't know if the erratic behavior is being caused by the drugs themselves or an underlying condition. It's all very tricky for those in contact, inc. family, to know what to do.
