I think this may be a perfect example of what's know as a "submarine" patent, one that's granted well after the same technology is being marketed by others. It's a great scheme if you can get away with it. I think it all depends on the competence (or incompetence) of the patent officials in discerning the prior art. Fortunately, the patent can be contested and possibly ruled invalid. I think this thing will take quite some time to work itself out so I wouldn't expect any effect on the bottom line till then.

Well, I also think it was a bad idea for Aztech, considering they are not in the position they used to be (large OEM contracts). As far as digital mixing, Creative bought E-mu Systems, and E-mu has been doing that since the early 80's. Although I'm not aware if digital mixing is detailed specifically in their various patents. It was more like a "little" detail in their existing hardware designs.
