I think tracking was actually a good thing, and it's unfortunate it is illegal. Now many schools offer a system where students track themselves- without the help of counselors. It's more "fair", but it's less effective for the students, since they make constant mistakes in placing themselves in classes.

But there are so many flaws in the education system it would be impossible to list them all here. That said, considering the incredible diversity in our populations in US schools, I think we do a pretty good job of educating all comers. Especially when you consider many of our students come from Spanish speaking countries and have little formal education in English when they are dumped in to our schools- at grade levels from k-12th.

I agree. Yet here, we have a political party representing half the country that denigrates education and views the educated as "elites".
