You’re splitting semantic hairs on the purported distinction between a major amendment and a whole new agreement. From a practical standpoint, such a change would be a big deal no matter how you want to characterize it.

I don’t think the AG has actually been suspended, although SNY has presumably stopped aggressively courting new accounts in order to maintain the price stability of a duopoly.

Judge Gorton clearly had no intention of rescinding his own order on the PI, and the purported AG suspension was a convenient hook the Judge grabbed to justify the decision to maintain the PI pending appeal. Assigning more significance to it than that would be a mistake, IMO.
