You can "doubt" the "withdrawal" all you want. If a judge says that sales have been "suspended," I will take that at face value. The fact the the AG is not looking for new accounts is what is important, not that there may be sales being made under prior contractual obligations.

That fact that there are probably ongoing sales surely means that the new "hybrid" profit sharing will continue. It would be very hard for MNTA to argue otherwise, and I don't agree that NVS is somehow "screwing" MNTA. A contract is a contract and MNTA is still going to do pretty darn well. JMO.

Of course I read it. Did you read the order? I did. I also appreciate the duty of an attorney not to mislead the court.

But when the court cites representations of MNTA/Sandoz to the effect that "sales of the authorized generic have been suspended", I accept it at face value.
