What intrigues me is that Ackerman said in the piece that there is substantive constitutional argument to make that would support Obama's actions. Wonder why he, Ackerman, didn't make it--and if the WH counsel made it why then wasn't it disclosed? Makes me think there's some trickery afoot.

(Lousy) legal memo released supporting the recess appointments. Memo appears to be just a conclusion without supporting line of reasoning from case work--at least from what one can tell from the article in the WSJ.
