You really ought to expand your information sources beyond Murdochville. You can read the memo at justice.gov . Seems to be plenty of citations and case law there. I am not a lawyer and don't pretend to be one, but the claim that memo is " just a conclusion without supporting line of reasoning from case work" is a line I could see coming from Fox News. I'd expect the WSJ, even in its current Murdoch-infused incarnation, to do a little better, but maybe things are progressing there.

I see Win has already written a much better reply than I would have. It's the WSJ in its editorial work not doing its homework. I've read other articles about the same piece which suggest it's quite well done, argues that it's probable consequences are fairly ambiguous. But comes down on the side of the administration. Which, I gather condemns it in your view and that of the WSJ as "lousy."
