I think we have to find a way to take the "Fault' out of malpractice and make it like a workers compensation system. With Worker's Comp if you get injured on the job you get paid so much per injury per body part.

We could do the same if one was injured in a hospital. This would eliminate a lot of defensive medicine and keep insurance premiums stable.
